Effective date: 2 September 2026. Please read these terms before using Afterglow. By creating a gallery, uploading content, accessing a gallery as a guest, or placing a print order, you agree to be bound by them.
These Terms of Service (“Terms”) are an agreement between you and OptimusYou LLC, an Arizona limited liability company doing business as Afterglow, of 1820 E. Ray Road #1000, Chandler, AZ 85225 (“Afterglow,” “we,” “us”), governing use of getafterglow.app and the galleries hosted on it (the “Service”). Our handling of personal information is described separately in the Privacy Policy, which is incorporated into these Terms by reference.
Afterglow hosts a couple's wedding photographs and films in a gallery that guests can view, search, and add their own content to. A gallery is not sold with an expiration date: the Service is intended to keep a gallery available indefinitely, subject to Section 8 (Changes and discontinuation) and to the account and payment terms below.
Hosts. A couple (and any studio that shot the wedding) holds an account secured by credentials they control. A host is responsible for keeping those credentials confidential and for activity on their account.
Guests. Guests do not create accounts. Each household or party is given a personal access code by the couple, which opens the gallery and, where granted, restricted albums such as a rehearsal-only gallery. A guest is responsible for not sharing their access code with anyone the couple did not intend to have it.
You must be able to form a binding contract to use the Service. You must be at least 18 to create a gallery, hold a studio account, or place a print order. A guest of any age may view a gallery they have been given access to. We do not knowingly collect personal information from a child under 13; if you believe a child under 13 has provided us with personal information, write to us and we will delete it.
A guest who uploads their own photographs or videos to a gallery retains ownership of that content. By uploading it, a guest grants Afterglow, the couple, and (where applicable) the studio that shot the wedding a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content within the gallery, for as long as the gallery exists, solely for the purpose of operating the Service for that gallery. A guest represents that they have the right to upload what they upload, and that doing so does not infringe anyone else's rights.
Afterglow may remove content that violates these Terms or that we are required to remove by law, but does not pre-screen content before it appears in a gallery.
Where a wedding was shot by a photography studio, the photographs and films that studio uploads remain the studio's copyright. Uploading a gallery to Afterglow and handing it over to the couple does not transfer that copyright — it grants the couple a license to use the photographs and films for their own personal, non-commercial purposes, including viewing, downloading, sharing with guests, and ordering prints for themselves, their household, and their guests through the Service.
Print rights are set per gallery, by the studio or the rights holder. A couple's own use of the Service (viewing, downloading, and ordering prints for themselves) is available regardless. Whether guests may purchase prints of a gallery's photographs through the Service is a separate, explicit permission the rights holder must grant for that gallery; until it is granted, guest print ordering is not available on that gallery. Granting or withholding that permission is a decision for the rights holder to make, not Afterglow, and does not itself transfer or expand the underlying copyright.
Nothing in these Terms grants Afterglow any ownership interest in a couple's or a studio's photographs or films. Afterglow's rights are limited to what is needed to operate the Service — to host, process (including automated face indexing and content description, as described in the Privacy Policy), and display the content within the gallery it belongs to.
You agree not to use the Service to:
A couple's gallery is a one-time payment of $299, covering that one wedding, with no recurring charge and no storage limit. A studio may purchase a gallery wholesale, on behalf of a couple it shot, for $199 per wedding.
Print orders are placed and paid for through Stripe at the price shown at checkout, which includes shipping. Afterglow does not store payment card details. Prints are made to order, so an order can be cancelled only before it has been sent to the lab — in practice, within a few hours of being placed. After that it is in production and cannot be cancelled. If a print arrives damaged, misprinted, or is not what you ordered, tell us within 30 days of delivery and we will reprint it or refund it in full, whichever you prefer, with no requirement to return it. Refunds are issued to the original payment method. Because each print is made for one buyer, we do not otherwise accept returns for change of mind.
On a gallery a studio shot, the studio earns 30% of the profit on each print order placed against that gallery, paid on the schedule Afterglow publishes to studios. Profit means the retail price of the prints less what the lab charges to make them; shipping, payment-processing fees and sales tax are excluded from it, and sales tax is never treated as revenue. A studio's share is fixed at the moment each order is placed, so a later change to our pricing or to their terms cannot alter what they have already earned.
We may update the Service over time. If Afterglow ever needs to discontinue the Service, we will give at least 90 days' notice by email to the address on each affected account, and full- resolution download of everything in a gallery will remain available for the whole of that period. A promise to keep your photographs is worth nothing without a way to walk out with them, and that is as true at the end as at the beginning. We may also update these Terms; continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Afterglow does not warrant that the Service will be uninterrupted, error-free, or that face search will find every photograph a guest appears in.
To the extent permitted by law, Afterglow's total liability to you for any claim relating to the Service is limited to the greater of the amounts you paid us in the twelve months before the claim arose, or one hundred dollars. Nothing in these Terms limits liability that cannot lawfully be limited. To the maximum extent permitted by law, Afterglow will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising out of or relating to use of the Service.
We may suspend or terminate access to the Service for a host or guest who violates these Terms. A couple may stop using the Service at any time; because a gallery is paid for once and intended to persist, termination by a couple does not itself delete their gallery — deletion is handled as described in the Privacy Policy.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to them or to the Service will be brought exclusively in the state or federal courts located in New Jersey, and you and Afterglow each consent to the jurisdiction of those courts. If any provision of these Terms is held unenforceable, the rest remain in force.
Questions about these Terms can be sent to hello@getafterglow.app.
Afterglow is early, and these terms describe a product that is still being built. Where something here changes, we will update this page and say what changed rather than replacing it quietly.
